No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLIII Aizawl, Friday 11.7.2014 Asadha 20, S.E. 1936, Issue No. 354 NOTIFICATIONNo.B. 13011/5/2012-AC, the 8th July, 2014.In exercise of the powers conferred by section 16 of the Mizoram P ublic Records Act, 2011 (Act No. 15 of 2011), the Governor of Mizoram is pleased to make the following Rules, namely: 1.Short title and commencement: - 1.These rules may be called The Mizoram Public Records Rules, 2014. 2.They shall come into force on the date of their publication in the Official Gazette. 2.Definitions :- In these r ules, u nless t he context ot her wise requir es,- a)“Act” means The Mizoram Public Records Act 2011 (Act No. 15 of 2011) b)“appraisal” means the evaluation of public recor ds in a ssociation with the Mizoram S tate Archives; c)“classified records” means the files relating to the public records classified as top-secret, secr et, confidentia l and restrict ed in a ccordance with the procedure laid down in the Manua l of Departmental Security Instructions circulated by the Ministry of Home Affairs from time to time; d)“custody” means the possession of public records; e)“defunct body” means a corporate or non-corpora te body which has been wound up with no successor to carry on its functions; f)“Declassification” means downgrading the securit y classifications after their evaluation; g)“file” means a collection of papers relating to the public records on a specific subject-matter cons isting of correspondence, notes and appendix thereto and assigned with a file number; h)“for m” means the form appended to these ru les; i)“private records” means records lying in the possession of a private individual or with any non-governmental or ganisation; j)“recording” means completion of the process of closing a file after action on all issues considered ther eon. k)“records of permanent natur e” means the pu blic records being maintained after r ecording for a period sp ecified, under sub-rule (1) of rule 5 by the recor ds creating agency in accordance with the procedure laid in its Manual of Office Procedure or Instructions on the subject; I)“retention Schedule of records” means a Schedule which provides the period of retention; m) (i) “review” means periodical evaluation of recorded files on the expiry of the period of retention for determining their further retention or destruction, as the case may be; - 2 - Ex-354/2014 (ii) “review of classified public recor ds for downgrading” means evaluation of public records bear ing security marks Top secret, Secr et, Confidential and restricted. n)“Section” means the section of the Act; o)“Sta nding guard file” means a compilation of pa pers on a particular subject -matter consisting of copies of policy decision, orders, instructions or any another matter incidental thereto arranged in a chronological order; p)Wor ds a nd express ions used her ein a nd not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3 . Nomination of Recor ds Officer:- T he records creating a gency shall by an office order issued in pursuance of the pr ovision of sub-section (1) of section 5 of the Act nominate one of its officers, not below the rank or grade of a Superintendent, as the Records Officer. A copy of such office order shall be for warded t o the head of t he Archives. 4 . Maintenance of sta nding guard file:- T he Records Officer sha ll be r esponsible for maintaining and keeping a standing gu ard file and proper r ecord of the directions issued by the Director or head of t he Archives, as the ca se may be, in pursuance of the provisions of sub-section (2) of section 6 and shall produce the same for inspection a s and when required by the Director or head of the Archives, as the case ma y be. 5 . Acceptance of public records of permanent nature:- (1) The head of the Ar chives s hall accept for depos it and preservation public records of perma nent nature which have been retained after r ecording by the records creating agency in its records room for the last twenty five yea rs or more. (2) Records Officer shall intimate to the head of the Archives each year before 31st day of January, in Form-1, the pa rticula rs of a ll public recor ds of permanent natur e which are due for appra isal dur ing the year. (3) On r eceipt of an intimation under sub-rule (2), the head of t he Archives thr ough his officers, shall assist the records officer in conducting the appraisal of public records. When the appraisal is over, the records officer shall prepare, in triplicate, a transfer list in Form-2 of all public records and deposit the sa me for preservation with the head of the Ar chives who shall after his satisfaction retur n one copy of the tra nsfer list to the records officer a s a receipt of the public records. (4) If the records officer after appraisal deems it necessary to r etain any record or file of perma nent nature beyond the period of twenty five years, he may do so for reasons to be recorded in writ ing and under intimation to the hea d of the Archives. 6.Withdr awal of p ublic r ecor ds:- (1) If public r ecords deposited and preserved with the Archives is requir ed by the recor ds creating agency for any official purpose, then the recor ds officer sha ll send a duly signed and sta mped requisition slip in Form-3 to the head of the Archives. (2) The public records requisitioned under sub-rule (1) may be returned as soon as the purpose is achieved but shall not be retained beyond the period of six months by the records officer or the record creating agency. 7.Downgrading of classified records:- (1) The records creating agency shall by an office order authorise an officer not below the rank of the Under Secretary to the Government of Mizoram to evaluate and downgrade the classified records being maintained by it. A copy of such office order shall be forwar ded to the head of the Archives. (2) The officer so authorised under s ub-rule (1) shall evaluate the classified r ecords every fifth year for the purpose of downgrading. (3) After downgr ading if the officer declares any record as of perma nent nature, the same shall be deposited, and preserved with the head of the Archives after its appraisal. (4) The records deposit ed under this rule can be requisitioned for any official purpose a nd returned to t he head of the Archives in the manner provided under Rule 6. (5) Every year in the last week of June and December, a half-yea rly sta tement in Form-4 shall be furnished by the officer a uthorised under sub-rule (1) to the head of the Archives on the action taken for evaluation and downgrading the classified records. 8.Submission of Annual Report:- (1) The records officer nominated under Rule 3 shall furnish to the Director or head of the Archives, as the case may be, an Annual Report in Form-5 every year in the month of March of the following year. (2) The Director or head of the Archives, as the case may be, shall, thereafter, submit a repor t to the DP&AR, Government of Mizoram every year on the act ion taken by the Records Officer in pursuance to the provisions of clauses (a) t o (1) of sub-s ection 1 of section 6 of the Act. 9.Destruction of P ublic Recor ds:- (1) No Public Records shall be destroyed without being recor ded and reviewed. In t he month of January every year, each records creating agency sha ll record after cons ulting the records retention Schedule all those files on which action has been completed. This work shall be accomplished in consultation with the Record Officer. (2) No public r ecords which is more than twenty-five year s old shall be destroyed by any records creating agency unless it is appraised. (3) A list of all such public records which are proposed to be destroyed shall be prepared by the record creating agency in Form-6 which shall be r etained permanently for futur e reference. (4) The records officer shall furnish a half yearly report in Form-7 on recording, indexing, reviewing and weeding of records to the hea d of the Archives. (5) Records sha ll be destroyed either by burning or shredding in the pr esence of Record Officer. 10. Access to private records:- (1) Records acqu ired fr om priva te sour ces by way of gift or purchase or otherwise shall be made available for bona fide research subject to the conditions laid down by the donor. (2) Research scholars shall submit an application in Form-8 to the head of the Archives for permission to consult records. T he head of the Archives ma y refuse such permission in p ublic interest and for reasons to be recorded on the said application. (3) Wher ever microfilm rolls a nd any other digital data are available, the origina l recor ds shall not be supplied for consultation to research scholars. No copy of any recor ds shall be made by anyone without the prior permission of the head of the Archives. 11.Access to public records:- (1) The public records accepted for deposit and preservation under sub-rule (1) of Rule 5 shall be made available for bonafide consultation and research purposes s ubject to the provision of sub-section 1 of section 12 and the following conditions namely:- (i) a person who intends to consult the public records shall apply to the head of the Archives in F orm-8. The head of the Archives may refuse such permission in p ublic interest and for reasons to be recorded on the said a pplication. The applicant so accepted shall pay such Registr ation fee as may b e pr escribed by the Head of the Archives from time to time. (2) A person intending to cons ult the public records shall not - (a ) writ e and put any marks or indications on public records; (b) fold, tear, cut, crease, or otherwise da mage or mutila te public records; (c ) remove any public r ecords without obtaining the permission from the Director or head of t he Archives, a s the case may be; (d) be allowed to take any eatable or drinking products or smoking while consulting public r ecor ds; ( e) place anything or object on any public records with a view to make out any copy of the said records; (f) disturb or interrupt any other p erson while consulting the public r ecords; and (g) behave in a manner which, in the opinion of the head of the Archives is detrimenta l to the maintenance and preser vation of public records. 12.The Board may: (a) advise the Government on matters concerning administration, ma nagement, conservation and use of public records. (b) give directions for acquisition of records from priva te custody. (c) deal with such other matters as may be prescribed from time to time. 13. No. NE-313(MZ) 2006-2008Re. 1/- per pageVOL - XLIII Aizawl, Friday 11.7.2014 Asadha 20, S.E. 1936, Issue No. 354 NOTIFICATIONNo.B. 13011/5/2012-AC, the 8th July, 2014.In exercise of the powers conferred by section 16 of the Mizoram P ublic Records Act, 2011 (Act No. 15 of 2011), the Governor of Mizoram is pleased to make the following Rules, namely: 1.Short title and commencement: - 1.These rules may be called The Mizoram Public Records Rules, 2014. 2.They shall come into force on the date of their publication in the Official Gazette. 2.Definitions :- In these r ules, u nless t he context ot her wise requir es,- a)“Act” means The Mizoram Public Records Act 2011 (Act No. 15 of 2011) b)“appraisal” means the evaluation of public recor ds in a ssociation with the Mizoram S tate Archives; c)“classified records” means the files relating to the public records classified as top-secret, secr et, confidentia l and restrict ed in a ccordance with the procedure laid down in the Manua l of Departmental Security Instructions circulated by the Ministry of Home Affairs from time to time; d)“custody” means the possession of public records; e)“defunct body” means a corporate or non-corpora te body which has been wound up with no successor to carry on its functions; f)“Declassification” means downgrading the securit y classifications after their evaluation; g)“file” means a collection of papers relating to the public records on a specific subject-matter cons isting of correspondence, notes and appendix thereto and assigned with a file number; h)“for m” means the form appended to these ru les; i)“private records” means records lying in the possession of a private individual or with any non-governmental or ganisation; j)“recording” means completion of the process of closing a file after action on all issues considered ther eon. k)“records of permanent natur e” means the pu blic records being maintained after r ecording for a period sp ecified, under sub-rule (1) of rule 5 by the recor ds creating agency in accordance with the procedure laid in its Manual of Office Procedure or Instructions on the subject; I)“retention Schedule of records” means a Schedule which provides the period of retention; m) (i) “review” means periodical evaluation of recorded files on the expiry of the period of retention for determining their further retention or destruction, as the case may be; - 2 - Ex-354/2014 (ii) “review of classified public recor ds for downgrading” means evaluation of public records bear ing security marks Top secret, Secr et, Confidential and restricted. n)“Section” means the section of the Act; o)“Sta nding guard file” means a compilation of pa pers on a particular subject -matter consisting of copies of policy decision, orders, instructions or any another matter incidental thereto arranged in a chronological order; p)Wor ds a nd express ions used her ein a nd not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3 . Nomination of Recor ds Officer:- T he records creating a gency shall by an office order issued in pursuance of the pr ovision of sub-section (1) of section 5 of the Act nominate one of its officers, not below the rank or grade of a Superintendent, as the Records Officer. A copy of such office order shall be for warded t o the head of t he Archives. 4 . Maintenance of sta nding guard file:- T he Records Officer sha ll be r esponsible for maintaining and keeping a standing gu ard file and proper r ecord of the directions issued by the Director or head of t he Archives, as the ca se may be, in pursuance of the provisions of sub-section (2) of section 6 and shall produce the same for inspection a s and when required by the Director or head of the Archives, as the case ma y be. 5 . Acceptance of public records of permanent nature:- (1) The head of the Ar chives s hall accept for depos it and preservation public records of perma nent nature which have been retained after r ecording by the records creating agency in its records room for the last twenty five yea rs or more. (2) Records Officer shall intimate to the head of the Archives each year before 31st day of January, in Form-1, the pa rticula rs of a ll public recor ds of permanent natur e which are due for appra isal dur ing the year. (3) On r eceipt of an intimation under sub-rule (2), the head of t he Archives thr ough his officers, shall assist the records officer in conducting the appraisal of public records. When the appraisal is over, the records officer shall prepare, in triplicate, a transfer list in Form-2 of all public records and deposit the sa me for preservation with the head of the Ar chives who shall after his satisfaction retur n one copy of the tra nsfer list to the records officer a s a receipt of the public records. (4) If the records officer after appraisal deems it necessary to r etain any record or file of perma nent nature beyond the period of twenty five years, he may do so for reasons to be recorded in writ ing and under intimation to the hea d of the Archives. 6.Withdr awal of p ublic r ecor ds:- (1) If public r ecords deposited and preserved with the Archives is requir ed by the recor ds creating agency for any official purpose, then the recor ds officer sha ll send a duly signed and sta mped requisition slip in Form-3 to the head of the Archives. (2) The public records requisitioned under sub-rule (1) may be returned as soon as the purpose is achieved but shall not be retained beyond the period of six months by the records officer or the record creating agency. 7.Downgrading of classified records:- (1) The records creating agency shall by an office order authorise an officer not below the rank of the Under Secretary to the Government of Mizoram to evaluate and downgrade the classified records being maintained by it. A copy of such office order shall be forwar ded to the head of the Archives. (2) The officer so authorised under s ub-rule (1) shall evaluate the classified r ecords every fifth year for the purpose of downgrading. (3) After downgr ading if the officer declares any record as of perma nent nature, the same shall be deposited, and preserved with the head of the Archives after its appraisal. (4) The records deposit ed under this rule can be requisitioned for any official purpose a nd returned to t he head of the Archives in the manner provided under Rule 6. (5) Every year in the last week of June and December, a half-yea rly sta tement in Form-4 shall be furnished by the officer a uthorised under sub-rule (1) to the head of the Archives on the action taken for evaluation and downgrading the classified records. 8.Submission of Annual Report:- (1) The records officer nominated under Rule 3 shall furnish to the Director or head of the Archives, as the case may be, an Annual Report in Form-5 every year in the month of March of the following year. (2) The Director or head of the Archives, as the case may be, shall, thereafter, submit a repor t to the DP&AR, Government of Mizoram every year on the act ion taken by the Records Officer in pursuance to the provisions of clauses (a) t o (1) of sub-s ection 1 of section 6 of the Act. 9.Destruction of P ublic Recor ds:- (1) No Public Records shall be destroyed without being recor ded and reviewed. In t he month of January every year, each records creating agency sha ll record after cons ulting the records retention Schedule all those files on which action has been completed. This work shall be accomplished in consultation with the Record Officer. (2) No public r ecords which is more than twenty-five year s old shall be destroyed by any records creating agency unless it is appraised. (3) A list of all such public records which are proposed to be destroyed shall be prepared by the record creating agency in Form-6 which shall be r etained permanently for futur e reference. (4) The records officer shall furnish a half yearly report in Form-7 on recording, indexing, reviewing and weeding of records to the hea d of the Archives. (5) Records sha ll be destroyed either by burning or shredding in the pr esence of Record Officer. 10. Access to private records:- (1) Records acqu ired fr om priva te sour ces by way of gift or purchase or otherwise shall be made available for bona fide research subject to the conditions laid down by the donor. (2) Research scholars shall submit an application in Form-8 to the head of the Archives for permission to consult records. T he head of the Archives ma y refuse such permission in p ublic interest and for reasons to be recorded on the said application. (3) Wher ever microfilm rolls a nd any other digital data are available, the origina l recor ds shall not be supplied for consultation to research scholars. No copy of any recor ds shall be made by anyone without the prior permission of the head of the Archives. 11.Access to public records:- (1) The public records accepted for deposit and preservation under sub-rule (1) of Rule 5 shall be made available for bonafide consultation and research purposes s ubject to the provision of sub-section 1 of section 12 and the following conditions namely:- (i) a person who intends to consult the public records shall apply to the head of the Archives in F orm-8. No. NE-313(MZ) 2006-2008VOL - XLIII Aizawl, Friday 18.7.2014 Asadha 27, S.E. 1936, Issue No. 357 NOTIFICATIONNo. B. 13011/5/2012-AC, the 8th July, 2014.In exercise of the powers conferred by section 16 of the Mizoram P ublic Records Act, 2011 (Act No. 15 of 2011), the Governor of Mizoram is pleased to make the following Rules, namely: 1.Short title and commencement :- 1.These rules may be called The Mizoram Public Records Rules, 2014. 2.They shall come into force on the date of their publication in the Official Gazette. 2.Definitions :- In these rules, unless the context otherwise requires,- . a)“Act” means The Mizoram Public Records Act 2011 (Act No. 15 of 2011) b)“appraisal” means the evaluation of public recor ds in a ssociation with the Mizoram S tate Archives; c)“classified records” means the files relating to the public records classified as top-secret, secr et, confidentia l and restrict ed in a ccordance with the procedure laid down in the Manua l of Departmental Security Instructions circulated by the Ministry of Home Affairs from time to time; d)“custody” means the possession of public records; e)“defunct body” means a corporate or non-corpora te body which has been wound up with no successor to carry on its functions; f)“Declassification” means downgrading the securit y classifications after their evaluation; g)“file” means a collection of papers relating to the public records on a specific subject-matter cons isting of correspondence, notes and appendix thereto and assigned with a file number; h)“for m” means the form appended to these ru les; i)“private records” means records lying in the possess ion of a private individual or with any non-governmental or ganisation; j)“recording” means completion of the process of closing a file after action on all issues considered ther eon. k)“records of permanent natur e” means the pu blic records being maintained after r ecording for a period sp ecified, under sub-rule (1) of rule 5 by the recor ds creating agency in accordance with the procedure laid in its Manual of Office Procedure or Instructions on the subject; l)“retention Schedule of records” means a Schedule which provides the period of retention; m) (i) “review” means periodical evaluation of recorded files on the expiry of the period of retention for determining their further retention or destruction, as the case may be; (ii) “review of classified public recor ds for downgrading” means eva luation of public records bear ing security marks Top secret, Secr et, Confidential and restricted. - 2 - Ex-357/2014 n)“Section” means the section of the Act; o)“Sta nding guard file” means a compilation of pa pers on a particular subject -matter consisting of copies of policy decision, orders, instructions or any another matter incidental thereto arranged in a chronological order; p)Wor ds a nd express ions used her ein a nd not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3.Nomination of Records Officer :-The records creating a gency shall by an office order issued in pursuance of the provision of sub-section (1) of section 5 of the Act nominate one of its officers, not below the rank or gra de of a Superintendent, as the Recor ds Officer. A copy of such office order shall be for warded t o the head of t he Archives. 4.Maintenance of standing guard file :- The Records Officer shall be responsible for maintaining and keeping a standing gu ard file and proper r ecord of the directions issued by the Director or head of t he Archives, as the ca se may be, in pursuance of the provisions of sub-section (2) of section 6 and shall produce the same for inspection a s and when required by the Director or head of the Archives, as the case ma y be. 5.Acceptance of public records of permanent nature:- (1) The head of the Ar chives s hall accept for depos it and preservation public records of perma nent nature which have been retained after r ecording by the records creating agency in its records room for the last twenty five yea rs or more. (2) Recor ds Officer sha ll int imate to the head of the Archives each year befor e 31 s t day of January, in Form-1, the pa rticula rs of a ll public recor ds of permanent natur e which are due for appra isal dur ing the year. (3) On r eceipt of an intimation under sub-rule (2), the head of t he Archives thr ough his officers, shall assist the records officer in conducting the appraisal of public records. When the appraisal is over, the records officer shall prepare, in triplicate, a transfer list in Form-2 of all public records and deposit the sa me for preservation with the head of the Ar chives who shall after his satisfaction retur n one copy of the tra nsfer list to the records officer a s a receipt of the public records. (4) If the records officer after appraisal deems it necessary to r etain any record or file of perma nent nature beyond the period of twenty five years, he may do so for reasons to be recorded in writ ing and under intimation to the hea d of the Archives. 6.Withdr awal of public recor ds :- (1) If public r ecords deposited and preserved with the Archives is requir ed by the recor ds creating agency for any official purpose, then the recor ds officer sha ll send a duly signed and sta mped requisition slip in Form-3 to the head of the Archives. (2) The public records requisitioned under sub-rule (1) may be returned as soon as the purpose is achieved but shall not be retained beyond the period of six months by the records officer or the record creating agency. 7.Downgrading of classified records:- (1) The records creating agency shall by an office order authorise an officer not below the rank of the Under Secretary to the Government of Mizoram to evaluate and downgrade the classified records being maintained by it. A copy of such office order shall be forwar ded to the head of the Archives. (2) The officer so authorised under s ub-rule (1) shall evaluate the classified r ecords every fifth year for the purpose of downgrading. (3) After downgr ading if the officer declares any record as of perma nent nature, the same shall be deposited, and preserved with the head of the Archives after its appraisal. (4) The records deposit ed under this rule can be requisitioned for any official purpose a nd returned to t he head of the Archives in the manner provided under Rule 6. (5) Every year in the last week of June and December, a half-yea rly sta tement in Form-4 shall be furnished by the officer a uthorised under sub-rule (1) to the head of the Archives on the action taken for evaluation and downgrading the classified records. 8.Submission of Annual R eport :- (1) The records officer nominated under Rule 3 shall furnish to the Director or head of the Archives, as t he case may be, an Annual Report in Form-5 every year in the month of March of the following year. (2) The Director or head of the Archives, as the case may be, shall, thereafter, submit a repor t to the DP&AR, Government of Mizoram every year on the act ion taken by the Records Officer in pursuance to the provisions of clauses (a) t o (1) of sub-s ection 1 of section 6 of the Act. 9.Destruction of Public Records :- (1) No Public Records shall be destroyed without being recor ded and reviewed. In t he month of January every year, each records cr eating agency shall record after consulting the records retention Schedule all those files on which action has been completed. This work shall be accomplished in consultation with the Record Officer. (2) No public r ecords which is more than twenty-five year s old shall be destroyed by any records creating agency unless it is appraised. (3) A list of all such public records which are proposed to be destroyed shall be prepared by the record creating agency in Form-6 which shall be r etained permanently for futur e reference. (4) The records officer shall furnish a half yearly report in Form-7 on recording, indexing, reviewing and weeding of records to the hea d of the Archives. (5) Records sha ll be destroyed either by burning or shredding in the pr esence of Record Officer. 10.Access to private records:- (1) Records acqu ired fr om priva te sour ces by way of gift or purchase or otherwise shall be made available for bona fide research subject to the conditions laid down by the donor. (2) Research scholars shall submit an application in Form-8 to the head of the Archives for permission to consult records. T he head of t he Archives ma y refuse such permission in public interest and for reasons to be recorded on the said application. (3) Wher ever microfilm rolls a nd any other digital data are available, the origina l recor ds shall not be supplied for consultation to research scholars. No copy of any recor ds shall be made by anyone without the prior permission of the head of the Archives. 11.Access to public records:- (1) The public records accepted for deposit and preservation under sub-rule (1) of Rule 5 shall be made available for bonafide consultation and research purposes s ubject to the provision of sub-section 1 of section 12 and the following conditions namely:- (i) a person who intends to consult the public records shall apply to the head of the Archives in F orm-8. The head of the Archives may refuse such permission in p ublic interest and for reasons to be recorded on the said a pplication. The applicant so accepted shall pay such Registration fee as may be prescribed by the Head of the Archives from time to time. (ii) for eign national intending to consult the public records may be permitted only on the production of letters of introduction from their sponsor ing institution and diplomatic Mission;- 3 -Ex-357/2014 (iii) record, maps and cartogra phic records r elating to the Ministr y of External Affairs and Ministry of Defence, in r espect of Arunachal Pr adesh (including Eastern Section of the S ino-Indian border) Sikkim, Bhuta n, Nepa l, Tibet, China a nd Mya nma r and ar eas comprising P akistan and Bangladesh may be made ava ilable for consultation keeping in view the security and the defence of India or of any part of the territory thereof. Records relating to the Ministry of External Affairs, Home Affairs and Human Resource Development in resp ect of J ammu and Kashmir (including Gilgit and Chitr al) may also be made ava ilable for cons ultation keeping in view the security and defence of India or of a ny part of the territory thereof; (iv) provided that the head of the Ar chives refuse such consultation; (v) wherever microfilm rolls may be made available, the original records shall not be supplied for consult ation to resear ch scholar; (vi) repr ographic and tr anscription facilities may be made available on submission of an application in Form-9 and for such services the applica nt shall have to make the payment of such service charges a s may be fixed by the head of the Ar chives from time to t ime; (vii) a person consulting public records for the purpose of research .and publishing the work which is ba sed upon the material taken from the said records may acknowledge it a nd a copy or more be deposited to the Sta te Archives. (2) A person intending to cons ult the public records shall not - (a ) writ e and put any marks or indications on public records; (b) fold, tear, cut, crease, or otherwise da mage or mutila te public records; (c ) remove any public r ecords without obtaining the permission from the Director or head of t he Archives, a s the case may be; (d) be allowed to take any eatable or drinking products or smoking while consulting public r ecor ds; ( e) place anything or object on any public records with a view to make out any copy of the said records; (f) disturb or interrupt any other p erson while consulting the public r ecords; and (g) behave in a manner which, in the opinion of the head of the Archives is detrimenta l to the maintenance and preser vation of public records. 12.The Board may: (a) advise the Government on matters concerning administration, ma nagement, conservation and use of public records. (b) give directions for acquisition of records from priva te custody. (c) deal with such other matters as may be prescribed from time to time. 13.Allowances to the members of the Archival Advisory Board:- The members of the Archiva l Advisory Boa rd nominated by the Government under clause (c) of sub- section 2 of Section 13 shall dra w travelling a llowance and da ily allowance for attending the meetings of the Archival Advisory Board at the rates admissible t o Group ‘A’ officers of the r ank of Joint Secr etary under the Government of Mizora m or as may be prescr ibed by the Sta te Government from time to time. No copy of any recor ds shall be made by anyone without the prior permission of the head of the Archives. 11.Access to public records:- (1) The public records accepted for deposit and preservation under sub-rule (1) of Rule 5 shall be made available for bonafide consultation and research purposes s ubject to the provision of sub-section 1 of section 12 and the following conditions namely:- (i) a person who intends to consult the public records shall apply to the head of the Archives in F orm-8. The head of the Archives may refuse such permission in p ublic interest and for reasons to be recorded on the said a pplication. The applicant so accepted shall pay such Registration fee as may be prescribed by the Head of the Archives from time to time. (ii) for eign national intending to consult the public records may be permitted only on the production of letters of introduction from their sponsor ing institution and diplomatic Mission;- 3 -Ex-357/2014 (iii) record, maps and cartogra phic records r elating to the Ministr y of External Affairs and Ministry of Defence, in r espect of Arunachal Pr adesh (including Eastern Section of the S ino-Indian border) Sikkim, Bhuta n, Nepa l, Tibet, China a nd Mya nma r and ar eas comprising P akistan and Bangladesh may be made ava ilable for consultation keeping in view the security and the defence of India or of any part of the territory thereof. Records relating to the Ministry of External Affairs, Home Affairs and Human Resource Development in resp ect of J ammu and Kashmir (including Gilgit and Chitr al) may also be made ava ilable for cons ultation keeping in view the security and defence of India or of a ny part of the territory thereof; (iv) provided that the head of the Ar chives refuse such consultation; (v) wherever microfilm rolls may be made available, the original records shall not be supplied for consult ation to resear ch scholar; (vi) repr ographic and tr anscription facilities may be made available on submission of an application in Form-9 and for such services the applica nt shall have to make the payment of such service charges a s may be fixed by the head of the Ar chives from time to t ime; (vii) a person consulting public records for the purpose of research .and publishing the work which is ba sed upon the material taken from the said records may acknowledge it a nd a copy or more be deposited to the Sta te Archives. (2) A person intending to cons ult the public records shall not - (a ) writ e and put any marks or indications on public records; (b) fold, tear, cut, crease, or otherwise da mage or mutila te public records; (c ) remove any public r ecords without obtaining the permission from the Director or head of t he Archives, a s the case may be; (d) be allowed to take any eatable or drinking products or smoking while consulting public r ecor ds; ( e) place anything or object on any public records with a view to make out any copy of the said records; (f) disturb or interrupt any other p erson while consulting the public r ecords; and (g) behave in a manner which, in the opinion of the head of the Archives is detrimenta l to the maintenance and preser vation of public records. 12.The Board may: (a) advise the Government on matters concerning administration, ma nagement, conservation and use of public records. (b) give directions for acquisition of records from priva te custody. (c) deal with such other matters as may be prescribed from time to time. 13.Allowances to the members of the Archival Advisory Board:- The members of the Archiva l Advisory Boa rd nominated by the Government under clause (c) of sub- section 2 of Section 13 shall dra w travelling a llowance and da ily allowance for attending the meetings of the Archival Advisory Board at the rates admissible t o Group ‘A’ officers of the r ank of Joint Secr etary under the Government of Mizora m or as may be prescr ibed by the Sta te Government from time to time. In exercise of the powers conferred by the proviso to Article 309 of the Constit ution of India , the Governor of Mizoram is pleased to make the following rules regulating the method of r ecruitment to t he post of Director under Sericulture Department, Government of Mizor am, namely: 1.Shor t title and (1) These Rules may be called the Mizoram Sericulture Department commencement - (Group ‘A’ post) Recruitment Rules, 2014. (2) They shall come into force from the date of their publication in the Official Gazette. 2. Application - These rules sha ll apply t o the posts specified in column 1 of Schedule annexed to these rules. 3. Number of posts, The number of the said post(s), their classification, Pay Band and classification, pay band Grade Pay/Pay Scale attached thereto shall be as specified in columns and grade pay/pay sca le - 2 to 4 of the aforesa id Schedule. 4. Method of The method of recruitment to the sa id posts, age limit, qualifica tion recr uitment, age and other matters r elating thereto shall be as specified in columns 5 limit, qualifications, etc - to 14 of the said Schedule. Provided that the upper age limit prescribed for direct recruitment may be relaxed in t he case of candidates belonging to the Scheduled Castes/the Scheduled Tribes and other special ca tegories of persons in a ccordance with the or ders issued by the Central Government or the Government of Mizoram, as the case may be from time to time. 5. Disqualification - No person, - (a) who has entered into or contra cted a marriage wit h a person having a spouse living; or - 2 - Ex-363/2014 (b) who, having a spouse living, ha s entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post(s); Provided that the Governor may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other gr ounds for doing so, exempt any such person from the operation of this r ule. 6.Training and Every Government servant recruit ed under these rules shall u ndergo such Departmental training or pass such Departmental Examination(s) as may be prescribed Examination - fr om time to time. 7. Powers to transfer - Notwithstanding anything contained in these rules, the Governor of Mizoram, in public interest, shall have power to transfer any Officer(s) so recruited under these rules to any other post or position which is equivalent in rank or grade. 8. Power to relax - Wher e the Governor is of the opinion that it is necessary or exp edient s o to do, he ma y, by or der and for reasons to be r ecor ded in writing a nd in consultation with the Mizoram Public Service Commission through the Department of Personnel & Administrative Reforms, relax any of the provisions of these rules with respect to any class or category of persons. 9. (2) It shall come into force from the date of its publication in the official Gazette. 2.Amendment of rule 9 : In Rule 9 of the Principal Rules, clause (b) of sub-rule (2) shall be substituted by the following, namely :- “the electoralroll of the relevant p art of the ward”. 3.Amendment of rule 55 : Cla use (e) rule 55 of the Principal Rules shall be substituted by the following, namely :- “a child in arms accompanying a voter”. 4.Amendment of rule 56 : Sub rule (2) of rule 56 of the Principal Rules shall be substituted by the following, namely :- , “where a paper seal is used for securing a ballot box, the Presiding Officer shall affix his own signa ture on the paper seal andobtain thereon the signa tures of such of the polling agents present as are desirous of affixing the sa me”. 5.Amendment of rule 57 : Rule 57 of the Principal Rules shall be substituted by the following, namely :- “immediately before the commencement of t he poll, the Pr esiding Officer shall also demonstrate to the polling agents and others present that the marked copy of the electoral roll to be used during the poll does not conta in any entry other than that ma deas per the provisions of Rule 52”. 6.Amendment of rule 58 : Sub rule (3) of rule 58 of the Principal Rules shall be substituted of the following, namely :- “in deciding the right of a person to obta in a ba llot pa per the Presiding Officer or the pollingofficer, as the case may be, shall overlook merecler ical or printing errors in an entry in the elector al roll, if he is satisfied tha t such person is identical wit h the elector to whom such entry relates”. - 2 - Ex-364/2014 7.Amendment of rule 62 : Clause (f) of rule 62 of the Principal Rules there be substituted by the following, namely :- “exit the polling station”. 8.Amendment of rule 64 : Sub rule (1) of rule 64 of the Principal Rules shall be substituted by the following, namely :- “a n elector who ha s inadvertent lyhandled his ballot paper in such a manner that it cannot be conveniently used as a ba llot pa per may, on returning it to the Presiding Officer and on satisfying himself of the ina dvertence, be given a nother ballot paper, a nd the ballot paper so retur ned and the counterfoil of such ballot paper shall be marked ‘spoilt :cancelled’ by the Pr esiding Officer”. 9.In Chapter VIII of the Pr incipal Rules, after rule 90 a new Rule, namely Rule 90A shall be added as follows, namely :- Rule 90A : No person, if elected at the same time in the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly, shall be a member of the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly by holding dual or more office simultaneously. In such eventualit y, he shall, within 7 (seven) days fr om the declaration of the election result of the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly or within 7 (seven) days from publication of these rules in the Official Gazette inform in writing under his hand, the Commissioner or the Chief Electoral Officer, as the ca se may be, his seat of choice in the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly. Once he has made his choice, he shall inform whichever is a ppropriate to such person, in writing under his hand, his r esignation as a member of the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legisla tive Assembly the concerned authority. The C ommissioner or the Chief Elect oral Officer, as the case may be, shall then declare the seat vacant as the case may be so vacated by notification in the Official Gazette. If, within 7 days from the declara tion of the election r esult or publication of these Rules a s aforesaid, the elected person fails to vaca te either of t he seats of Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Ass embly, the following rules shall apply: (1) “Sitting Local Council member elected to the Municipal Council shall be deemed to prefer the Municipal Council. His election to the Local Council shall become null and void and the Commissioner shall decla re his seat vacant at the Loca l Council”. (2) “Sitting Municipal Council member elected to the Lok Sabha/Rajya Sabha/State Legislative Assembly shall be deemed to prefer the latter. In such eventualit y, he shall, within 7 (seven) days fr om the declaration of the election result of the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly or within 7 (seven) days from publication of these rules in the Official Gazette inform in writing under his hand, the Commissioner or the Chief Electoral Officer, as the ca se may be, his seat of choice in the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Assembly. Once he has made his choice, he shall inform whichever is a ppropriate to such person, in writing under his hand, his r esignation as a member of the Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legisla tive Assembly the concerned authority. The C ommissioner or the Chief Elect oral Officer, as the case may be, shall then declare the seat vacant as the case may be so vacated by notification in the Official Gazette. If, within 7 days from the declara tion of the election r esult or publication of these Rules a s aforesaid, the elected person fails to vaca te either of t he seats of Local Council or Municipal Council or Lok Sabha/Rajya Sabha/State Legislative Ass embly, the following rules shall apply: (1) “Sitting Local Council member elected to the Municipal Council shall be deemed to prefer the Municipal Council. His election to the Local Council shall become null and void and the Commissioner shall decla re his seat vacant at the Loca l Council”. (2) “Sitting Municipal Council member elected to the Lok Sabha/Rajya Sabha/State Legislative Assembly shall be deemed to prefer the latter. His election to the Municipal Council shall become null and void and the C ommissioner shall declare his seat vacant a t the Municipa l Council”. L.
